A comparison of due managerial care of a member of governing body in the Czech Republic and a comparable duty of a member of governing body in Ireland

This paper deals with a comparison between the Czech duty of due managerial care of a member of governing body of limited company and the Irish non-fiduciary duty to exercise care, skill and diligence of a director of limited company (hereinafter also referred as "duty of care"). The paper aims to find out a possible way to improve legislation of the duty of due managerial care on the basis of comparison with the duty of care. The duty of care sets the ground for the comparison, therefore the paper deals first with the Irish legal status of the duty of care, which has been recently changed by the Companies Act 2014. Despite of the codification of the directors' duties, the core of interpretation and application of the duty of care still rests in judicial decisions. Nevertheless, the change of source and statutory wording of the duty means that the substance of Re City Equitable [1925] does not represent a good law anymore. The standard of care of Re City Equitable [1925] has been replaced by the minimal objective standard based on the British judgment Re D'Jan of London [1994]. The content of the duty of care is determined on the case by case basis, but in any event it consists of conclusions of the British judgment Re Barings [1999], which has been accepted by the Irish courts in restriction...
Consistency of answering and change of attitudes

5 ABSTRACT This bachelor's thesis follows the ongoing doctoral thesis of Mgr. Barbora Balková in the National Institute of Mental Health (NIMH) in Klecany. The NIMH research is concerned with broad personality feature as a part of personality traits that can be psychologically meaningful and measurable, and part of the integrity of the personality. My thesis is therefore divided into two parts; theoretical part and empirical part. Theoretical part is concerned with attitudes and their changing, consistency in answering and also with personality traits of an individual. Empirical part is following up to knowledge from the theoretical part and it is concerned with correlations between consistency in answering and changing of attitudes. Another aims of this part in this bachelor's thesis were to find if there is a relation between changing of attitudes and personality trait (Openness) and if there is a relation between consistency in answering and personality trait (Conscientiousness). For measuring my respondent's feedback I used the following methods: personality test BFI-44, attitude scale and method to measure the consistency in answering which was developed by experts in National Institute of Mental Health. Voluntary restrictions and self-commitment Abstract in English In our work, we summarize the topic of dual self and propose various types of restrictions the long-run self might impose on the myopic self concerning procrastination, health and emotions. Then we design a questionnaire aimed to find to what extent do the real people behave in such way, and what are the determinants of such behavior. We find that the phenomenon of voluntary restriction of self is present in our contemporary society to large extent. Women have a tendency to restrict themselves significantly more than men, while higher Cognitive Response Test (CRT) score, higher education and lower conscientiousness cause lower interest in the self-regulatory facilities.
ADHD a přístup k dětem ADHD v mateřských a základních školách

How teachers from pre-schools and primary schools treat children with ADHD syndrome ADHD (Attention deficit hyperactivity disorder) syndrome is psychological disorder that has three main symptoms : impulsivness, hyperactivity and inattetion. Because of these three symptoms, children with ADHD have often serious problems at school. Even if they try their best to have good marks they usually dont, because of their inability to concentrate. Because of the symptoms of the condition, they are usually not well behaved compare to thier classmates. Thats why ADHD syndrome can often cause conflicts between students and teachers and between children and their parents too. Nowadays ADHD affects around 3-5% of children .This means that every teacher will most likely come in to contact with ADHD at some point in their career. With this in mind, are teachers really well informed about ADHD? Do they really treat children with psychical disorders appropriatly? Children with ADHD usually dont like school because they are never successful and good as their peers. Although they dont like studying they still have thier favourite teachers . But which characteristics should an ideal teacher have when working with these children? Which characteristics would these children best relate to? This is obviously a huge subject to look at, we could examine a million different teaching approaches, but for my diploma work I have decided to consider the five which are for me the most important ones {--} extraversion, agreebleness, emotional stability, openness to experience and ability to resist stress. For my research i used two anonymous questionnaires - Big Five Test and Sense of Coherence Test. Next method was test with only five question that examines a teacher´s knowledge of Attention Deficit Hyperactivity Disorder. In addition to these, I also did interviews with children to find out which teachers they prefer to be taught by. As a teacher it can be challenging to have children with ADHD in your class. It needs a large amout of patience, because you wont see the results of your work for very long time. But if teachers and parents work together in supporting child sufferers of ADHD, and help to create a positive learning environment, they can make a difference and turn education into an enjoyable experience. By providing help with things that maybe easier for the rest of the class, and by promoting social activity between ADHD sufferers and their peers, teachers can create an eviroment that better for everyone.
